Grandparent Legal Rights

Question:  When do have standing to sue for access to their grandchildren?

Answer:   Some of the bases under which grandparents may have standing to sue for access to their grandchildren under Texas Family Code section 102.004, which requires proof that the child's environment presents a serious question concerning the child's health or welfare, or both parents consent. This is in addition to the standing provided by Texas Family Code section 102.003(13), which applies in the case that the child's parents are deceased.
